| 摘 要： | 随着科技的发展,网络产业在全球的蓬勃兴起,互联网的应用已经渗入到人类生活的方方面面,对人类社会生活产生了巨大的影响,并产生了具有财产外观的"存在"——虚拟财产,这种虚拟世界的"存在"所具备的财产性特征及其所包含的利益关系已经逐步被人们所接受。随之而来的是,与网络虚拟财产相关的法律问题也日益凸显,并已引起社会的广泛关注。但是,对于虚拟财产的法律属性问题,当前学界和司法实务界存在着很大的争议,相关立法也是一片空白,因此迫切需要研究网络虚拟财产属性等相关法律问题。本文通过对网络虚拟财产属性进行分析,进而得出结论,希望能为我国司法实务界提供相关参考。

| Abstract: | With the development of technology and the rise of network industries in the world,Network applications have permeated every aspect of human life,which had a tremendous impact on human social life and created the appearance of a property’s "existence"——virtual property,The virtual property with the property characteristics and interests have gradually been accepted.However,Virtual property legal problems have become increasingly prominent and has attracted wide attention.But how the characterization of virtual property,the academic sector and judicial practice there are a lot of controversy,the relevant legislation is also a blank space,therefore,there is an urgent need to study Virtual property legal issues.This thesis through the analysis the properties of virtual property and concluded,hope for which can provide reference for our judicial practice. |
