| 摘 要： | 我国现行民事诉讼法涉及未成年人民事案件程序方面的规定,已经明显不适应司法实践和保护未成年人合法权益的需要。审理未成年人民事案件应适用与普通民事诉讼程序不同的特别程序。我们应当通过完善立法,明确规定未成年人案件的适用范围、管辖、诉讼主体、举证要求和强制性调解程序的前置、审理等,设立专门的审判组织,通过特别程序来强化对未成年人权益的法律保护。

| Abstract: | The provisions on minors civil procedures in the current Civil Procedure Law of the People＇s Republic of China are unable to meet the needs of judicial practice and the protection of minors＇ legal rights.The trying of minors civil cases should apply special legal procedures different from ordinary civil procedures.It is hecessary to improve lenislation to,specify the scope of application,jurisdiction,subject of litigation,requirements of adducing evidence,proced compulsory conciliation measures and trying,etc and setting-up special trial organization and special legal procedures to reinforce the protection of minors＇ rights and interests. |
