论教育公平的正义维度

摘    要:教育公平问题的探讨需以受教育权利与受教育义务为切入点,将该问题放到社会体制的背景中,社会体制便是探讨教育公平问题的正义维度,以分配正义与补偿正义、制度正义与个人正义为基本的分析概念。由此,在法哲学与伦理学的视域内,教育公平问题便转化成了受教育权利作为法治社会的基本人权如何公平实现的问题。同时,在应然与实然的范畴内,在国家与公民、国家与个人等关系范畴内,公平与正义作为法律价值则指向了受教育权利如何得以公平实现上。

Abstract:The discussion of the problem of the educational fairness needs to take the right and duty to receive education as a breakthrough point,and the problem must be considered in the background of the social system,which is the dimension of justice in the discussion of educational fairness with the distributive justice and the compensation justice as well as the system justice and the personal justice as the basic analysis concepts.Thus in the view of the philosophy of law and the ethics,the problem of the educational fairness will be converted into the problem on how to realize the right to receive education as the basic human right in a society governed by law.Meanwhile,within the categories of"as it should be"and"as it is"and of the relationship between the state and the citizen and between the state and individuals,fairness and justice as legal values actually lie in how to fairly realize the right to receive education.
