| 摘 要： | 随着高等教育改革的不断深入,高校与学生的争讼案件频繁发生,转型中的高等教育暴露出的高校管理法律缺陷使得高校的管理工作处于"难管"的尴尬境地。采用"重要性"理论正确界定高等学校与学生之间的法律关系,加强对高等学校的管理和监督,规范高等学校的管理,实现依法治校。

| Abstract: | With the innovation of higher education, lawsuit cases frequently occur between colleges and students. The law limitation of college management in the transformation of higher education puts college management into embarrassment. In this case, colleges need to adopt the theory of ＂Importance＂ to make clear of the law relationship between colleges and students, enhance the administration and supervision and standardize colleges and universities by law. |
