| 摘 要： | 公平价值是法律正义的基础,是法律价值判断的终极性尺度,虽然经济学理念的引入使得法律价值判断中的效率观念日趋彰显,但是,笔依然认为“效率优先,兼顾公平”的惯用话语形式不能适用于法律的价值判断当中,在公平与效率的价值抉择中,正确的选择应当是而且只能是公平优先,兼顾效率”。
