| 摘 要： | 我国官本位思想仍然十分严重,导致刑事辩护的空间比较狭小。无罪辩护是刑事辩护的最高层次,拥有的空间更加狭小,但是不可否认仍存在成功无罪辩护的案例。本文主要从犯罪构成、正当化事由以及证据不足的角度论述无罪辩护的可能空间,以期对我国刑事辩护制度的完善有所帮助。

| Abstract: | In our country,official standard is still very severe,so there is narrow room for criminal defense.There is still narrower room for innocent defense since it is the top of the criminal defense.However,there are a lot of successful cases of innocent defense.The writer discusses the possible room for innocent defense,in the light of constitution of a crime,subject of justification and insufficient evidence,so as to help improve China's criminal defense system |
