| 摘 要： | 由于生命权的唯一性和不可逆转性,因此对于适用死刑的程序应当有更为严格和精密的要求,以确保法律的公正。为使死刑限制适用的程序更加完善和科学,在立法和司法实践中可从以下几方面加以完善:1.对死刑案件的二审公开化;2.死刑案件证据运用严格化;3.赋予死刑案件的上诉以自动性与强制性;4.合理保障面对死刑的人的辩护权;5.增设死刑救济程序,完善赦免制度。

| Abstract: | Theoretically,death penalty is to be abolished,yet because of the limitation of social reality,it is still necessary to have the penalty,under stricter and more scientific control than the procedure validity for other criminal sanctions,so as to have more rigorous procedure to impose death penalty and to assure the right of the condemned criminal. |
