| 摘 要： | 大陆法系国家与英美法系国家的检察机关作为国家的公诉机关,均享有公诉职权,但二者拥有的职权范围和起诉裁量权不同。借鉴两大法系国家检察官公诉权的各自优势,我国人民检察院应在简化酌定不起诉的操作程序、增加暂缓起诉的规定、取消“转诉”规定和适当规定检察机关的求刑权等方面加大改革力度,以求完善。

| Abstract: | The procuratorial organs in both the continental legal system countries and British-and-American legal system countries share the prosecution rights as the national prosecution organs,but they differ in the duty range and prosecution discretion.With the reference of their advantages of both legal systems,People's Procuratorate in our country should simplify the operational process of non-prosecution,and increase the regulations about mitigation of prosecution,abolish 'transfer prosecution',and appropriately stipulate the right of sentence pursuit as the procuratorial organ. |
