| 摘 要： | 婚姻财产契约的效力是法律赋予契约当事人以及有关第三人为某种行为的权利或者说是婚姻财产契约对当事人的拘束力以及契约义务不履行时法律的保障力。按照效力范围不同婚姻财产契约的效力包括主体效力、客体效力和时间效力。运用契约理论从以上三个方面分析婚姻财产契约的效力,以期在婚姻财产契约中充分体现契约自由、意思自治,减少法律纠纷,给未来完善婚姻财产立法提供建议。

| Abstract: | In order to realize the content of the contract,the law permits the party and the third-party to behavior.The legal effect of the marital property contract should include the subject effect,object effectiveness and time effectiveness.The research is to analyze the legal effect of marital property contract using the contract theory.The significance is improving the theory of marital property and perfecting the freedom rule within the marital property field and reducing legal disputes and indicating the legislation about marriage law in the future. |
