| 摘 要： | 解决国际投资争端中心(ICSID)虽然是国际社会建立的一个专门解决国际投资争议的国际机构，但由于其对争议无强制管辖权，争议解决程序无时限和涉及国家当事人的裁决往往因国家主权豁免而得不到有效执行等缺陷，导致了该机构没有有效发挥作为多边国际投资争议解决中心所应有的作用。随着WTO协定中“与贸易有关的投资措施协议”(TRIMs)的达成，将WTO争议解决机制(DSM)引入了多边国际投资领域，DSM所具有的强制管辖权、确定的程序时限和有效的裁决执行方法等特点必将使DSM对多边国际投资争议机制产生巨大的影响。

| Abstract: | ICSID was established by the international community as an international institute for resololving the multilat-eral disputes. But this institute had not been used effectively because of many disadvanteges, such as autonomous jurisdiction, no procedural period limit and that the decisions related to state parties cannot be enforced for the immunity of sovereignty. When TRIMs was concluded in WTO, the DSM of WTO was introduced into the dispute settlement mechanism of multilateral investment. The DSM,which has advantages of mandatory jurisdiction,specified time limit of procedure and effective enforcement measures of the decisions , will produce an huge influence on dispute settlement mechanism of multilateral investment. |
