| 摘 要： | 国家赔偿法意义上的精神损害是因精神权利遭到公权力的侵犯而引起的精神痛苦或精神利益的丧失、减损。可能引起精神损害的只能是公民人身权被侵犯，主要包括公民的生命健康权、人身自由权、荣誉权、名誉权、肖像权、姓名权、法人人身权。权利保护机制给予了公民精神损害的请求权，但精神损害的无形性可能会导致赔偿的无序性，为解决这一问题，实践中必须掌握精神损害赔偿的二分法原则，通过引入精神损害评估机制，利用引证判例、参照民事赔偿、合理使用法官的自由心证等方法构建合理有序的赔偿制度。

| Abstract: | Spiritual damage in state compensation means citizens’ spiritual rights have been violated by the state power therefore leading to citizens’ spiritual pains and sufferings or loss of spiritual interests.Only citizens’ personal human rights that have been violated can result in spiritual compensation,including rights of human liberty,life,health,reputation,honors,as well as rights related to names,portraits,and those of legal persons.Rights protection organism has provided people tools to pursue spiritual remedy,but the Abstraction of spiritual damage may lead to disordered compensation.In order to solve this issue,we need to establish reasonable compensation systems by using dual principles on spiritual damages,introducing spiritual damage evaluation system,utilizing previous research and precedents,consulting other civil compensations and reasonably exerting the judge’s discretion. |
