| 摘 要： | 知识产权质押法律风险的产生可归至知识产权与生俱来的客体无形性、时间性、权利被授予性、价值不稳定性等特殊性。知识产权质押客体的特殊性致使知识产权质权的实现面临诸多障碍。据此，应紧密结合知识产权的固有属性，采取相应的风险防范对策，优化知识产权质押的担保功能。
