| 摘 要： | 我国刑法对未成年罪犯适用罚金刑不违背罪责自负原则,而且有利于对未成年人的教育改造,也符合刑法谦抑性的要求,而未成年人罚金执行难问题,并不足以否定未成年人适用罚金刑的合理性。同时,《刑法》中所规定的得并制罚金刑、必并制罚金刑和单处罚金刑对未成年人的适用规则也非常明确。

| Abstract: | Minors penalty in China’s criminal law doesn’t violate the principle of "the responsibility for an offense is proud",and it meets the the Modest Proposal and will be helpful for minors education and transformation.Difficult to execute it can’t deny its reasonableness.At the same time we make clear of how to apply criminal penalties for minor juvenile offenders in the case of the Criminal law for must,Combined Criminal and Free may,and only penalty which are provisioned in the criminal law. |
