| 摘 要： | 随着我国体育产业的快速发展，国家颁布的促进政策越来越多，这些政策布局范围广、力度大，在实践使用的过程中日渐成熟，对体育产业的全面快速发展意义深远，具备了法律化的条件。虽然政策具有灵活性、及时性和针对性的优点，但也具有稳定性差和刚性不足的缺点，而法律稳定性、规范性和刚性的特点，可以通过法律化确保政策的稳定落实。因此，目前是我国进行体育产业政策法律化的时机，尤其是国务院"46号文"。就体育产业政策法律化而言，未来的体育产业立法至少应着力解决好明确立法形式、产业范围和发展定位，提升产业创新发展意识，确立和保护体育产权，建立财税优惠制度，助力体育产业国际化等几个重要问题。

| Abstract: | With the rapid development of the China's sports industry, the number of policies promulgated by the state to promote the sports industry is increasing. These policies have a wide range of scope and strength, involving many fields of the sports industry, and are becoming more and more mature in practice and in promoting the sports industry. The comprehensive and rapid development has far-reaching significance and legal conditions. Although the policy has the advantages of flexibility, timeliness and pertinence, it also has the disadvantages of poor stability and insufficient rigidity. The stability, normative and authoritative characteristics of the law can achieve stable implementation of policies through legalization of policies. Therefore, China has already reached the stage of legalization of sports industry policies, especially No. 46 Document of the State Council. As far as the legalization of sports industry policies is concerned, the future sports industry legislation should at least focus on clear legislative form, industrial scope and development orientation, enhancement of the awareness of sports industry innovation and development, establishing and protection of sports property rights, establishing a fiscal and tax incentive system, and sports industry internationalization. |
