| 摘 要： | 对我国目前城市住宅小区业主委员会的现状进行分析,表明我国业主委员会根据《物业管理条理》的规定是难以组成和难以运行的,建议修改条例的相关规定,从立法上给予业主委员会独立法人地位,可采用公司法人的构建模式,同时实行业委会组成人员的职业化.

| Abstract: | Through analyzing the present situation of house - owner committee in urban residential community, this article reveals that according to "Property Management Regulation", the house - owner committee is difficult to form and operate. So it suggests revising some regulations to guarantee the independent corporate position of the house - owner, committee, adopting the structure model of company corporate, meanwhile, making the members of owner committee professional. |
