| 摘 要： | 社区教育作为全面依法治国、依法治教和学习型社会建设背景之下的"全民学习,终身学习"的重要平台,当前是其立法的最佳时机.文章就我国社区教育国家层面的立法空缺和地方性社区教育立法逐步发展的现状,通过对国内外社区教育立法、国内其他教育立法进行横纵比较研究,分析了我国社区教育立法的必要性与可行性,提出了应从国家层面制定"社区教育促进法",并将确立社区教育立法定位、创建社区教育开展机制、健全社区教育经费保障机制、建立社区教育管理体制、明确各主体间的权责等相关内容融入其中.

| Abstract: | Community education,as an important platform for"national learning and lifelong learning",provides a practical ba-sis for its legislation. Under the background of comprehensive rule by law,the present is the best time for legislation. The author com-bines legislative vacancy of national community education and the gradual development of local community education legislationwith the vertical and horizontal comparative study of domestic and foreign community education legislation and other domestic educational legisla-tion. Then it analyzes the necessity and feasibility of community education legislation in China. On the basis of the above analysis,the author proposes that the Community Education Promotion Law should be drawn up from the national level. And the content of establis-hing community education legislation,creating community education mechanism,improving community education funds safeguard mechanism,establishing the management system of community education and clearing the main responsibilities should be included. |
