| 摘 要： | 学生受教育权不客侵犯，而实践中侵害大学生受教育权的现象屡见不鲜。鉴于此．引进司法救济制度，平衡高校与学生之间的法律关系，保障学生受教育权的充分实现具有十分重要的现实意义；完善和发展我国的司法救济制度，对促进“依法治教”进程和宪政改革的发展具有十分重要的历史意义。

| Abstract: | It is a basic right for university students to enjoy being educated according to law,which is the ultimate aim of school education and it should never be infringed.However,the events that infringe the right of university students often have taken place.Therefore,it has important and realistic significance in adopting the institution of judicial relief,which aims to protect the realization of the rights of the rights of university students.Improvement and development of Chinese judicial relief have very important historical meaning in prompting the progress of managing education by legal and the development of government's constitutional reformation. |
