| 摘 要： | “法治”观并不是凭空产生的,它的形成有着社会政治、经济和文化基础。资本主义商品经济的发展历程,人们对经济发展规律的体验以及我国建立社会主义市场经济的经验、教训决定了社会经济的发展必须塑造“法治”经济。经济发展的规律,个人自由、权利的保障同时也呼唤着政治民主,进而产生对“法治行政”,对建立“法治国家”的“需求”。此外,自然法思想的确立、文化大众化的不断发展以及和谐理念的提出也都为法治观的形成奠定了坚实的文化基础。

| Abstract: | The conception of rule of law is formed on the political and cultural foundation.The development process of capitalist commodity economy,people's experience about the rule of the economic development,and the object lesson about the formation of socialist market economy decided that the evolution of social economy must figure the "rule of law "economy.At the same time,the rule of the economic development and the protection of the right of personal liberty have been calling on political democracy and the rule of administrative law.Furthermore,the establishment of the idea of natural law and the sustainable development of the popularization of culture and harmonious culture has settled a firm cultural foundation on which the conception of rule of law is formed. |
