| 摘 要： | 处于危机重重的晚清政府,为寻求残喘,希冀以法制改革为突破口,在法律移植的进程中,对中国法制的形式作出了选择。表现在刑事法律上,晚清在刑事法律＂文本＂上建构一个近现代化的法律体系,本文只探究《大清新刑律》的立法成就,同时以刑罚人道主义为视角,认为体现该精神的一些规定超脱了社会现实,但仍具有进步性,并提出在应注重自身问题研究。把自身具有人类共性的一些优良元素保存下来,这样的法制现代化更具实益。

| Abstract: | At the end of nineteenth century and in the early days of the twentieth century,the government of Qing Dynasty in the crisis-ridden wished the reforment of law for a breakthrough to competite among themselves.In the process of legal transplantation,it made a choice of the form of the Chinese legal system.Manifested in the criminal law,government of Qing danasty constructed the modern legal system in the text of criminal law.This article explores the legislative achievements of the new criminal code of Qing Danasty exclusively,simultaneously,in perspective of the doctorine of humanitarian criminal punishment,it holds that some of the provisions embodies the spirit detach from social reality,but it has a progress,this article proposes that study should focus on the problems and keep fine elements of common humanity of itself.the modernization of law has more benefifs. |
