行政法视野下的高校校规

摘    要:高校校规作为一种规范手段必然会对高校与学生间的互动关系产生影响,根据是否会影响学生的基本法律地位,高校校规可以划分为自律性规则和法源性规则两大性质不同的类型。高校管理权的公共行政因素决定了高校校规的设定应遵循合法性原则、平衡原则和参与原则三项基本行政法原则。从程序上保障学生在校规制定中参与权的实现是监督高校校规的有效方式之一,行政监督和司法审查是对高校校规予以法律控制的基本途径。

Abstract:As a regulatory means the colleges and universities regulations will inevitably influence the relations between school and students. According to the influence on the basic legal status of students, they can be divided into two types: self-rule regulations and law-source regulations. Three administrative law principles must be followed in laying down school regulations, namely, the principle of legality, the principle of balance and the principle of participation. The basic supervisory ways are administrative supervision and judicial review. Additionally, it is an effective supervisory way to ensure the realization of the participation right of students in laying down school regulations.
