| 摘 要： | 国家赔偿的归责原则是指国家承担赔偿责任的依据和标准。通过对国家赔偿归责原则的功能的论述及其归责类型的比较，进而阐明我国国家赔偿的归责原则，采用了“违法行使职权”的原则，并对其含义进行了说明。
