| 摘 要： | 新修订的《刑法修正案（八）》以及《刑事诉讼修正案》对“社区矫正”正式的规定更是对我国社区矫正组织管理体系的确立提出了迫切的要求。完善社区矫正组织管理体系，推进社区矫正的贯彻执行是大势所趋。在我国，由于社区矫正制度起步较晚，对于社区矫正，我国刑法、刑事诉讼法、监狱法以及其他相关的法律法规和司法解释虽然都有明确的规定，但是法律规定过于简单笼统，使得社区刑罚和社区矫正难以具体落实，其优势也难以发挥，因此社区刑罚与社区矫正制度的改革与完善势在必行。矫正主体由矫正机构和矫正人员构成，本文为寻求制订切实的法律法规、配套的执行制度，着重在矫正机构的组建、矫正工作的人员的任选方面，即对矫正主体的设置问题上，做出试探性的研究。

| Abstract: | The recently issued Criminal Law Amendment(the Eighth Version) and Criminal Procedure Law Amendment give a clear definition of community correction,it is thus urgent for China to develop such an organizational management system to explore fully its advantages.While there are some regulations and interpretations concerning community correction in Chinese legislative body such as Criminal Law,Criminal Procedure Law,Prison Law and others,the definition is still not clear enough.Moreover,this system is far from mature.Therefore,it is necessary to further perfect this mechanism.This paper proposes that subject of community correction should consist of parties and individuals concerned.The paper finally endeavors to discuss the construction of the subject in terms of legislation,execution,organization and personnel drafting etc. |
