| 摘 要： | 在最高人民法院的具体推动下，审判公开的实践取得了巨大的成就，但也出现了一些问题。审判公开的价值包括实体价值和程序价值，其实体价值就是人权保障，对当事人权利和公民权利的保障，其程序价值包括目标价值即司法公正和形式价值即正当法律程序。基于审判公开的价值审视审判公开的实践，有助于发现审判公开实践中的问题，指引审判公开实践的未来发展。

| Abstract: | On the specific promotion of the Supreme People’s court, practice of open trial has made great achievements, but also appeared a few problems. Open trial values include the entity value and procedure value. The entity value is the guarantee of human rights, including the right of the litigant and the rights of citizens. Procedure value including the target value is justice and due process of law is the form of value. The value of open trial can help to find the problem in the practice of open trial and guide for future development of open trial. |
