| 摘 要： | 中世纪初期，西欧社会的政治关系复杂，其主要力量君主、教会、地方贵族鼎足而立，政治结构无序而分散，导致法律结构的参差交错，同一社会内部各种不同的法律体系和司法管辖权并存，彼此又权限不明、互相交叉，其中普通法、教会法、庄园法、日耳曼习惯法和残存的罗马法等，相互间的矛盾与争斗，将中世纪西欧的法律体系搞得支离破碎。

| Abstract: | In the early period of the Middle Ages, the political relationship of the western European societies was complicated, the main forces were empires, the churches and the local aristocrats. The political structure was out of order and non-centralized, which led to the intercourse and overlapping of the legal structure, co-existence of different laws and the judicial jurisdictions in the same society. The power of each law was not clear. The common law, the church law, the plantation law, the Germanic law and the Roman law were mutual contradictory and struggled against each other. All of these destroyed the legal systems of the western Europe in the Middle Ages. |
