| 摘 要： | 酒后驾驶行为是对公共安全具有高度侵害危险的类型性危险行为,具有类型化的法益侵害危险。将其犯罪化,不仅是当今世界防范这种类型性法益侵害危险行为的主流,也得到了风险社会理论的支撑。对重大法益进行提前保护是我国刑事立法的方向,而我国现行的基本以行政处罚为主的规制方式,对于酒后驾驶行为的威慑和防范明显不力,我国对于酒后驾驶行为也应犯罪化。
