| 摘 要： | 制约公立义务教育学校法人行为能力的内因有三点 :一是法人的公共性和公益性特点的突出使其处于困境 ;二是权利和义务具有不对应性 ,限制了行为能力 ;三是生存和发展不受市场规律的制约。制约行为能力的外因有多种 ,主要有三点 :一是教育政策的调节能力有限 ,二是法律不完善 ,三是教育社会化趋势的负面影响。建议从四个方面入手增强行为能力 :一是把好资格关 ;二是理顺关系 ,明确责任界限 ;三是推进教育体制改革 ;四是优化办学的社会环境

| Abstract: | There are three internal causes conditioning the juridical person's disposing capacity of public schools for compulsory education: the juridical person is strikingly of public nature and public welfare and is thus landed in predicament, the unparallel of right and duty conditions the disposing capacity, and existence and development are not controlled by the market law. The external causes are chiefly the limitation of educational policy adjustment capacity, the unperfection of law, and the negative effect of the trend of educational socialization. There are four ways of strengthening the disposing capacity: strict examination of qualification, demarcation of duty, promotion of education system reform, and optimization of social environment for education. |
