| 摘 要： | 战时中立是国际法范畴的概念,从法理上看,不适用于一国内战,然而历史上一国在他国内战采取中立的事例不胜枚举。美国内战中英法等欧洲国家的中立就是较为典型的个案,英法等国的中立具有特殊的历史背景和政治意义;名为中立、实为干涉,从实质上看是一条独特的干涉之路。英法等国中立的核心是利益,正是为了利益,英法的干涉图谋破产。但在战略利益方面英国从其中立政策中渔利颇多。

| Abstract: | Neutrality in the period of war is the concept in international law,which is not fit for the civil war from the philosophy of law.However,there are many cases,for instance Britain and France declared their position of neutrality in American Civil War.There are special historical background and political significance for their neutrality,which can be perceived as a special interference,for the core is the benefit. |
