| 摘 要： | 道德的法律化是法治的基础,法律的道德化是法治的内涵。道德的法律化是人类的道德思想、道德原则、道德规范铸为法律的过程,它在一定程度上直接决定着法律的本质,从而为法治的构成建构了基石;法律的道德化是法律转化为更高的道德习惯和道德义务的过程,是法律得以被主体普遍遵守的必然体现。因此,法律的道德化和道德的法律化是法治得以成立的不可缺少的两个阶段,也是人类由人治走向法治的自然历史过程。

| Abstract: | Morality lawed is the foundation of law ruling, law moralized is the intention of law ruling.Morality lawed is the process of human beings' moral ideology,moral principle,moral standardization turned as law,to some extent,it can decide directly the essence of law,and can become the foundation of law ruling.Law moralized is the process of law turned to the higher moral habit and moral obligation,and it is the necessary reflection of law's universal obey by us.So morality lawed and law moralized is the very important processes of law ruling,and it is also the history necessity of our path on the law ruling. |
