| 摘 要： | 当前,我国食品安全监管体系正在逐渐完善,但规制环境污染导致食品安全问题的法规尚未出台.传统食品安全问题解决机制大多局限于个别消费者的民事赔偿与行政机关的行政处罚,无力从整体上解决环境污染导致的食品安全问题.环境公益诉讼的引入有助于维护公民基本生存权、食品安全权.积极探索环境公益诉讼在食品安全保障方面的应用,是完善我国食品安全保障的必要路径.

| Abstract: | At present, China＇s food security supervision system is gradually improving, but the law enforced to the food security problem caused by the environmental pollution has not been taken into practice. The resolution of traditional food security problem is mainly limited in the civil compensation of some consumers and the administrative punishment of some administrative organizations, which can not solve the food security problem caused by environmental pollution as a whole. The introduction of environmental public interest litigation will protect citizens＇ basic living right and the food security right. It is vital to explore the application of environmental public interest litigation actively for the improvement of China＇ s food security. |
