| 摘 要： | 《信息网络传播权保护条例》的实施为图书馆使用和传播数字作品提供了法律依据，但它没有承认数字图书馆的法律地位，对数字图书馆在信息获取、信息服务及资源共享等方面造成了较大的影响。面对我国现行法律与数字图书馆建设的矛盾冲突，图书馆界应深入研究我国的法律法规，并积极投入到法律条文的修订中去。
