| 摘 要： | 中国城市化的时代背景决定了我国农村集体土地所有权有继续存在的必要性,但是现阶段我国集体土地所有权仍存在主体虚位、客体不稳定、权能缺失等弊端。要解决好这些问题,就必须在城市化进程中对集体土地所有权制度进行主体归位、稳定客体、恢复集体土地所有权的各项权能,从而使中国农村土地真正走出集体所有权制度的困境。

| Abstract: | The time background of China＇s urbanization determines the necessity for rural collective land ownership in China to continue to exist. However,the absent subject,objects instability,lack of power and other defects still exist at the present stage of China＇s collective land ownership. To solve these problems,it is necessary to make clear the subject of collective land ownership system,stablize the object,restore the power of collective land ownership in the process of urbanization,so that the rural land can be out of the collective plight in China. |
