| 摘 要： | 我国《著作权法》第十一务第三款“单位作品”的规定与第十六条第二款“特殊职务作品”的规定常发生适用上的混乱。关于这一点，本文从何谓单位作品入手，着重分析单位的作者地位问题及其他相关问题，以期更好地理解与适用相关法律规定。

| Abstract: | There is always confusion in the application of Article 11th Section 3rd about Institutional works and Article 16th Section 2nd about Duty works in the Copyright Law of China. As far as this issue is concerned it will mainly discuss the question about the status of Institutional Author and other related questions in this article, which is hoped to be helpful to understand and apply legal regulations concerned much better. |
