| 摘 要： | 保险合同应当是要式合同,在保险人签发保单时成立,但投保人支付了保险费的,在支付保险费时成立。合同成立符合法定的生效要件时合同生效,但合同当事人可以对合同生效附加条件,当条件成就时,合同才生效。保险人开始承担保险责任的时间应当是双方约定的时间,保险人在保单中单方面确定的保险责任开始的时间应溯及至支付保险费之时。
