| 摘 要： | 我国慈善组织由于没有确立独立的法人地位而影响了其自身在构建和谐社会中的作用。慈善法律的缺失和不完善造成了慈善组织建设滞后,慈善组织本身存在的问题影响了民众捐赠的积极性。慈善事业的发展需要实现政府与慈善机构的分离,需要法律制度的完善,需要加强慈善机构的组织建设,以发挥慈善事业在维护社会公平正义,构建和谐社会中的作用。

| Abstract: | In our country charitable organizations have not established their status as independent legal person,which affects its function in the construction of harmonious society. The flaws and imperfection of charitable laws lead to the lagging-behind of the charitable organization construction and the problems in charitable organizations themselves have been disencouraging the public＇ s donating enthusiasm. For the development of charities, charitable organizations should be separated from government, legal system needs perfecting and the construction of charitable organizations needs strengthening so as to bring into full play the role of the charitable organizations in maintaining social justice and constructing harmonious society. |
