| 摘 要： | 本文剖析了世贸组织争端机制运作程序证明：一方面争端解决机制与GATT相比,更显权威性。公正性,且迅速、有效,其适用范围更加广泛及涉及国际经贸各个领域,是世界贸易组织中解决争端的最高机构;另一方面建构其的“301条款”的直接翻版,美国可以随时以“国家利益”为由,适用“301条款”进行报复,构成了对争端解决机制潜在不稳定性的威胁。在此提出完善争端解决机制的若干思考及对我国加入世贸组织的认识。

| Abstract: | This paper testifies: on the one hand, the dispute settlement mechasm is moe authoritative, impartially,promptly and efficatdrisly than the system of GATT, its terms of applicatdri is moe extensive in all fields of international trades. It is the supreme institution for settling disputes in the WTO. But on the other hand, the mechanjsm is based on the "301" clauses which is made use of retaliatory machanism by the USA to deal with the disputes happened in its international trades, So, the USA may cite the "301" clauses to make retaliate in order to protect its national interests which can cause the potential intimidation of stability to the dispute settlement mechanism. The author tables a proposal to perfect the mechanism and gives his opinions of our country's seeking to join the WTO. |
