| 摘 要： | 我国现行法律对事实婚姻的态度经历了承认、有条件承认、不承认和相对条件承认4个阶段,这一方面体现了法律的一定的灵活性和严肃性,也体现出法律保护公民婚姻权的价值取向。另一方面却体现了事实婚姻认定不完善、重形式轻实质、制度设计不到位等问题。

| Abstract: | Our present laws have gone through stages in handling de facto marriages: accepting,accepting upon conditions,not accepting,and relative accepting upon conditions.These attitudes showed both the sternness and the flexibility of the law and the value orientation of protecting citizens' marriage rights.On the other hand,they also indicate the cognizance of de facto marriage is not perfect,the stress is still laid on the form and the system needs to be improved. |
