| 摘 要： | 功能性作品是指以实现某种特定功能而非表达个人思想观点为创作目的的作品。与一般文艺科技作品相比，功能性作品的功能性使其在创作空间、商业生命等方面有诸多不同。根据功能性作品自身的特点构建功能性作品的保护条件、权利内容、权利限制、侵权责任等制度规范，是功能性作品著作权制度的应有之义。文章从《著作权法》第三次修改对于建筑作品、实用艺术作品、图形作品、立体作品的修订入手，对比分析《伯尔尼公约》及具有代表性的外国相关规定，介绍我国功能性作品著作权保护的历程及现状，并提出相应的完善建议。

| Abstract: | Functional works is a kind of works created to achieve a specific function rather than to express ideas. The functionality makes functional works different from traditional copyright works in many aspects. The copyright protection for functional works should include rules regarding protection conditions, limitations of rights and infringement liability to mathch the characteristics of functional works. Based on the third amendment to China＇s Copyright Law for architectural works, graphic works, three-dimensional works and works of applied art, this paper tends to discuss the copyright protection for functional works in China and tries to make some suggestions. |
