| 摘 要： | 我国现行体育纠纷解决机制存在严重的弊端，已无法完整、高效地解决当前的体育纠纷。在体育仲裁已成为世界各国共同发展趋势的大背景下，我国有必要构建国内的体育仲裁制度。从仲裁的性质、仲裁范围、仲裁模式、对国际体育仲裁的承认与执行以及司法监督5个方面，论述了我国体育仲裁制度的构建既要顺应市场经济对体育仲裁本身的要求，又要与国际全面接轨；从体育仲裁程序的特殊性的角度阐述了我国体育仲裁制度构建的程序设计要求。

| Abstract: | There are many drawbacks existing in prevailing dispute-resolving mechanism in China,which can not settle current Chinese sports disputes entirely and effectively.Under the background that constructing sports arbitration has become a common tendency through the world,it is essential to set up Chinese sports arbitration system.This paper discusses how to establish Chinese sports arbitration system,from the aspects of the nature,the range,the mode of the sports arbitration,as well as the recognition and enforcement and judicial supervision of foreign arbitral awards,which not only should meet the demands of marked economy,but also should be coordinated with international practices.Meanwhile,how to structure the procedure of Chinese sports arbitration system,which should meet the special demands of sports arbitration,also has been presented. |
