| 摘 要： | 遗嘱自由作为私法领域意思自治原则的体现原本无可厚非,但随着我国社会主义市场经济的发展,各种价值观、伦理观激烈冲撞,在尚未形成稳定的体系之前各种社会矛盾大量涌现.为此,该种理所当然的"自由"必须受到适当的限制.本文从遗嘱自由限制的历史起源,各国立法状况及对我国现行继承法缺陷的分析入手,阐述了遗嘱继承中引入特留份制度的必要性和可行性.

| Abstract: | As the reflection of the rule autonomy of the will in private law,freedom of testament system is beyond reproach,but with the development of socialist market economy,various values and ethics collide fiercely,many social contradictions appear.For this reason,this "freedom" must be restricted properly.By analysing the origin of main states' legislative system and the flaws of inheritance law in operation,the article expounds the necessity and feasibility of drawing into legal portion system. |
