| 摘 要： | 自从研究经济法理论以来,我先后提出过四种理论观点:"结合论"、"纵横统一说"、"分合论"、"社会基本矛盾论"。它们所处的时期、阶段不同,名称也有异,但主旨思想和理念却一贯始终,30年不变。在东西方经济法产生、形成上如果找不出共同的原因,它就无规律可言,就无法形成统一的经济法科学。现代经济法产生、形成的一般条件有:社会化的大生产和发达的(或比较发达的)商品经济,即现代市场经济;有组织管理经济职能的现代国家机器;有公法与私法结合的综合系统调整经济的现代法学理论思想和法律体系。经济法理论所主张的划分和确立法律部门的标准有两个:客观标准和主观标准。经济法主张主客观标准统一论。此外,有关法的基本原则、主旨观念、调整功能等,也都可作为进一步划分和确立法律部门的标准。自1986年《关于〈中华人民共和国民法通则〉(草案)的说明》公布后,经济法界发生了"守纵去横"的倾向,过度强调国家主导地位和决定作用的"国家论"成为经济法理论中的最强音。如果没有国家介入经济生活,就没有经济法。但我不同意"国家论"过度强调国家的绝对主导作用,过度漠视企业的基础地位。搞纵横分裂、想让经济法偏安于"纵向"一角是没有出路的。

| Abstract: | Since I devoted myself to the study of economic law theory,I have successively proposed four theoretical perspectives:"the Theory of Combination","the Verticality and Horizontality Unified Theory","the Separation-Integration Theory" and "the basic social contradiction Theory".Although they are proposed at different historical stages,and are represented with different names,but the substance of thoughts and ideas have always been the same three decades.If we don’t investigate the common causes on the formation of economic law in the East and West,or there is no general law at all,a unified science of economic law will certainly difficult to form.The general conditions of the modern economic law’s formation include:the socialization of production and developed(or relatively developed) commodity economy,namely the modern market economy;the modern state apparatus with organized management of economic functions;the modern law science theory and legal system with combination of public law and private law for the systematic adjustment of economy.The standards for dividing and constructing the law department advocated by the economic law theory are two-fold:the objective and subjective criteria.Economic law advocates the unity of subjective and objective standard.In addition,the basic principles of the law,subject,core ideas and adjustment function,etc.,could also be used as further dividing and constructing standards of the law department.Since the explanation on the draft of "the General Principles of Civil Law" published in 1986,in the economic law science,there is a tendency "to keep verticality and to abandon horizontality".Some scholars excessively emphasis on "the state theory",which becomes the strongest in the theory of economic law.What I do not agree with "the state theory" lies in its too much emphasizing on the absolute leading role of the state and excessive ignoring the basis of status.It is no way out to engage in breaking up verticality and horizontality,and confining economic law in the corner of "verticality". |
