| 摘 要： | 民事立法中已经确立了精神损害赔偿制度,刑事附带民事诉讼在本质上属于民事诉讼,但其中的精神损害赔偿问题却一直得不到解决。文章在对刑事附带民事诉讼精神损害与赔偿涵义界定的基础上,结合我国的立法与实际,从理论和实践的角度,同时考虑到保护被害人的合法权益、不同法律部门的协调和域外立法的借鉴等方面,深刻地阐述了在我国刑事附带民事诉讼中确立精神损害赔偿的必要性和可行性。

| Abstract: | Spiritual damage compensation system has been established in civil legislation and civil suits collateral to criminal proceedings are, in essence, of civil nature, hut the spiritual damage compensation has not been solved until now. Based on the definition of the meanings of civil suits collateral to criminal proceedings and compensation and combined with Chinese legislation and practice, the paper, from the perspective of theory and practice, elaborates the necessity and feasibility of spiritual damage compensation in civil suits collateral to criminal proceedings, taking into consideration protecting victims＇ rights and interests, coordination among different legal departments and reference of foreign legislation. |
