| 摘 要： | 互联网时代的发展使人们对音乐作品的需求从实体唱片逐渐转移到数字音乐领域,从无人管理的免费点播下载阶段进入现今的数字音乐独家许可模式。这种模式在现阶段具有其优势,但仍存在着许多弊端,其强制性损害了其他主体的利益,许可费用过高,缺乏统一、规范的标准及监管。在现阶段需规制现存的数字音乐独家许可模式,缩短专有许可的期限、避免过高的许可费用、制定统一的格式文本,之后再过渡到著作权集体组织进行统一集中管理。

| Abstract: | The development of the Internet age has gradually shifted the demand for music works from physical records to the field of digital music, from the unmanaged free on-demand download stage to the current exclusive licensing model of digital music. This model has its advantages at this stage, but there are still many drawbacks. Its mandatory damages the interests of other subjects, excessive licensing fees, and lack of uniform and standardized standards and supervision. At this stage, it is necessary to regulate the existing digital music exclusive license model, shorten the exclusive license period, avoid excessive license fees, formulate a unified format, and then transition to the copyright collective organization for unified and centralized management. |
