| 摘 要： | 信任是诚信经营的基本前提,研究分析杭州“人脸识别第一案”背后的信任危机问题,对数字记录保管者的信任重建具有积极意义。基于认知平衡理论与数字记录的基本内涵,解析数字记录信任危机产生的原因,阐释化解信任危机的意义、信任重建主体及重建内容,建议从转化传统数据保护意识,形成以国内法为梁柱、国际法为配筋的法律体系,深化技术与社会治理能力,增强信息产业自律等多维路径探索信任危机解除之平衡点,建立强关系,化信任失衡为信任平衡,重建数字记录信任。

| Abstract: | Trust is the basic premise of business integrity management. The study on the trust crisis behind the "First Case of Face Recognition" in Hangzhou has some enlightenment significance for the reconstruction of the public's trust in digital records keepers. Based on the meaning of cognitive balance theory and digital records, it analyzes the causes of the trust crisis, the significance of resolving the trust crisis, the main body and contents of trust reconstruction. It suggests transforming traditional data protection consciousness, forming a legal system with domestic law as the pillar and international law as the reinforcement, improving the capacity of technology and social governance, enhancing the self-discipline of information industry and other multi-dimensional paths to explore the balance point of relieving trust crisis, establish a strong relationship and turn trust imbalance into trust balance, in order to reconstruct the trust of digital records. |
