| 摘 要： | 农村房屋买卖必然涉及宅基地使用权转让问题,对农村宅基地使用权转让设定限制必然会损害农民利益,损害债权人利益,妨碍法院执行工作,也会因规避法律规定而滋生腐败等现象。文章具体分析了目前宅基地使用权转让中的问题,进而得出农村宅基地使用权应该自由转让的结论。

| Abstract: | Countryside house business involves the homestead right of use transfer question inevitably,Its transferring limit can harm the farmer benefit,harms the creditor benefit,hinders the court execution work,also can multiply because of the circumvention legal rule phenomena and so on corruption.This article has specifically analyzed in the present homestead right of use transfer question,then drew the conclusion which the countryside homestead right of use should transfer freely. |
