| 摘 要： | 异化是马克思主义哲学的基本概念。刑罚是人类创设用以惩治犯罪的客体工具,但刑罚史的发展表明,人面临刑罚异化的困境。菲利的"刑罚替代物"理论是人类走出刑罚异化的一次自觉反思。但直至今天,刑罚异化现象仍然存在,刑罚的复归仍未到来。

| Abstract: | Alienation is the basic concept of Marx's theory.Penalty is created as the object tool to punish crimes at first.However what has happened in the history of penalty indicates human being has lost in the predicament of alienation of penalty."Alternative penalties" of Fnrico Ferri is an attempt to go out of alienation of penalty.But even now,the phenomenon of penalty alienation still exists and the reversion of penalty has not yet arrived. |
