| 摘 要： | 制度优于人性是西方政治哲学的一个基本观点，也是邓小平政治制度哲学的鲜明特色，西方性恶论基础上的制度设计不无启示，中国传统性善论可能是人治的痼疾。法德兼治是符合人性发展的制度安排。

| Abstract: | It is a basic view of the western political philosophy and a striking feature of Deng Xiaoping political institutional philosophy that institution is superior to human nature.The design of institution based on the theory of original evil of human nature in the west is of elicitation.The chinese traditional theory of goodness of human nature may be a serious defect to the rule by man.Rule by law and moral is an institutional design adapted to development of human nature. |
