| 摘 要： | 著作权制度兴起的18、19世纪,正是独创性观念盛行之际。浪漫主义运动把独创性观念渗透到各个领域包括著作权领域。独创性观念对著作权法的影响是以作者概念为中介实现的。把独创性作为著作权法保护的基本条件是历史的巨大进步,作者的知识权益得以保护,这极大地激发了作者的创作积极性。但是著作权理论对于独创性概念的理解还不统一,没能注意到借用中的创造性转换现象,致使现行司法实践在判断作品侵权时还有失准确。

| Abstract: | Copyright system was born in 18-19 th Century,when the original idea prevailed. It influenced various fields,including copyright by the Romantic Movement. The influence was based on the concept of author. It is a tremendous progress in history to set a basic condition in copyright law with originality,because the author's enthusiasms are greatly stimulated when their rights of knowledge are protected. However,the understandings of the original idea are still not unified,the phenomenon of creative transformations in literary creation are not paid attention to,some judgments about literature in the current judicial practice of copyright are not proper. |
