| 摘 要： | 以主体为标准,法律可以划分为“私法———社会法———公法”三个领域。作为第三法域的社会法指社团法。它依托于“公共领域“和“私人领域”之间的“社会领域”,反映着市民社会的团体性特征。社会法中的“社会”特指正式的社会组织。社会法所调整的社会利益也特指社会团体的利益。

| Abstract: | With regard to the legal subject,the law may be divided into three major areas: private law,public law and social law.As the third area of the law,social law mentioned in the article refers to corporation law.It relies on "social sphere",which lies between the "private sphere" and the "public sphere".It reflects the group characteristic of civil society.The word "social" in the term refers in particular to the formal social organizations,and social interests that are adjusted by social law point to the benefits of social groups. |
