| 摘 要： | 把版权法上的技术中立原则和理念引入到网络侵权行为研究中，以网络侵权领域三方主体利益为起点，论述基于技术中立原则和理念的网络服务商责任分配，提出现行立法加重了网络服务商的侵权责任这一核心观，占、。技术中立的价值主要体现在对网络服务商法律责任的限制，分别从明确网络服务商的主体、完善网络服务商侵权责任的构成要件、合理量化网络服务商的归责原则、限制网络服务商的侵权责任等几个方面加以阐述。

| Abstract: | Introduce the principle of technology neutrality that copyright law on the network tort, from the analysis of network tort field tripartite interests beginning, discusses the ISP liability allocation based on a technology neutral idea, finally puts forward the legislation adds to the current ISP this core idea of tort liability. Discusses the technology of neutral value is mainly manifested in the limits of ISP liability, respectively from the body of the ISP clear, perfect the components of the ISP, rational quantify the imputation principle of ISP, restrict the ISP of tort liability, etc. |
