| 摘 要： | 从政治制度理论、法治理论、民权与人权学说三方面看,首先,伍廷芳对民主与专制国体、君主立宪、直选总统制、总统间接选举制政体的比较研究,说明他借鉴民主政治理论的得失。其次,整理他的法治理论,并比较沈家本等的观点,可以发现伍廷芳学习近代法治原则方面存在的成就与不足。最后,依据伍廷芳的民权人权学说及其与孙中山思想的异同,可以确定他对近代民权人权理论的接受水平。

| Abstract: | The writer clarifies the theory of political system,legal theory,and hypothesis of civil right in the first place,and describes the comparative study of democracy,monarchy,national election of presidency by Wu Tingfang.Furthermore,the writer compares Wu Tingfang's hypothesis of rule by law with Shen Jiaben's viewpoints.In addition,Wu Tingfang's thoughts are compared with those of Sun Yatsen's,so as to determine the level of his acceptance of the modern civil rights. |
